Delaware County Traffic Diversion Program

The Delaware County District Attorney's office runs a Traffic Diversion Program (TDP) for minor traffic offenses. This program is available to drivers with a limited violation history. If you qualify and complete the program, your case gets dismissed. That means no points on your record and no conviction showing up on your driving abstract.

The TDP costs $317 total. That breaks down to $250 for the DA fee, $55 for the Advent Course fee, and $12 for the card processing fee. You must complete an online traffic safety course through Advent eLearning within 30 days from the date of your application. Successful completion results in a full dismissal of the charge. This is a big deal because a dismissal keeps points off your license and avoids the Driver Responsibility Assessment fees that come with convictions.

If you are not eligible for the TDP, the DA's office also offers a Traffic Reduction Program. This option reduces the points on your ticket but does not dismiss the case entirely. The cost is $90, which includes a $25 administrative fee, a $60 Advent Course fee, and a $5 processing fee. You still pay court fines on top of that amount. But the point reduction can be significant. It might keep you below the 6-point threshold where the Driver Responsibility Assessment kicks in, or help you avoid reaching the 11-point suspension mark.

Delaware County has 23 local Justice Courts. Each one handles traffic tickets issued in its jurisdiction. The court name and address are on your ticket. District Attorney Shawn J. Smith and the DA's staff handle all criminal proceedings in Delaware County Court and in those 23 local courts. The DA's office works with the NY State Police, Delaware County Sheriff's Department, and police departments in Delhi, Colchester, Walton, Hancock, and Sidney.

The DA's office is at 1 Courthouse Square, Suite 5, Delhi, NY 13753. Phone: 607-832-5299. Fax: 607-832-6045. If you want to apply for the Traffic Diversion or Reduction Program, contact this office. You can also reach the Delaware County Sheriff at 280 Phoebe Lane, Suite 1, Delhi, NY 13753. Phone: 607-832-5555. Hours are Monday through Friday, 8:00 AM to 4:30 PM. Sheriff Craig S. Dumond leads the department.

Delaware County Traffic Ticket Fines and Penalties

Fines for Delaware County traffic ticket records follow the state schedule. Under VTL Section 1800, a first conviction for a traffic infraction can mean a fine up to $150. A second offense within 18 months jumps to $300. A third goes to $450. Surcharges are added on top. Speeding fines have their own scale under VTL Section 1180. Going 1 to 10 mph over is $45 to $150. Exceeding the limit by 11 to 30 mph brings $90 to $300. Over 30 mph carries $180 to $600.

The Driver Point System applies to every conviction. If you hit 6 points in 18 months, you owe a $300 Driver Responsibility Assessment plus $25 per year for each point above six. At 11 points, your license can be suspended. Taking the Traffic Diversion Program to get a dismissal avoids all of this. That is why the $317 program cost can save you much more in the long run.

Does Delaware County Have a Treatment Court

Yes. Delaware County operates a Treatment Court as an alternative to traditional prosecution for certain cases. This court focuses on substance abuse issues rather than traffic infractions. It is separate from the Traffic Diversion Program. The Alcohol and Drug Abuse Council also provides services in the county. If your traffic ticket involves a DWI or drug-related charge, the Treatment Court may be an option your attorney can discuss with the DA's office.

How to Respond to Delaware County Traffic Tickets

Follow the instructions on the back of your ticket. You can plead guilty by mail and pay the fine. Some courts accept online payments. You can also appear in person on your court date. If you want to apply for the Traffic Diversion or Reduction Program, contact the DA's office before your court date. You must still notify the court that you are applying so they know not to issue a default judgment against you.

Do not ignore a Delaware County traffic ticket. Under New York law, failing to answer within 60 days triggers a license suspension. The court will tell the DMV, and a $70 fee per ticket gets added. Driving on a suspended license is a separate crime. If you need more time, call the court clerk to request an adjournment before your date passes. You can view your ticket details through MyDMV if you have lost the paper copy.
